General Terms and Conditions (GTC) for Online Trainings and Webinars

1. Definitions

1.1. CUSTOMER: The natural or legal person who commissions the online service (training or webinar) and makes the payment.

1.2. PARTICIPANT: The person attending the online service; this may be the same as the CUSTOMER.

1.3. ONLINE SERVICE: The online training or webinar provided by Fischer Consulting OHG for the CUSTOMER or PARTICIPANT.

1.4. TRAINER: The person appointed by Fischer Consulting OHG to conduct the online service; this can be Dr. Sabine Fischer or a person designated by her.

2. Scope of Service and Execution

2.1. Execution and Technical Requirements: The ONLINE SERVICE is provided exclusively online via platforms like Zoom, Microsoft Teams, or similar programs. The CUSTOMER is responsible for ensuring the technical requirements for participation (stable internet connection, functioning audio and video equipment, necessary software). The TRAINER assumes no liability for technical issues that impair or prevent participation.

2.2. Schedule and Duration: The date and time of the ONLINE SERVICE will be agreed upon in advance. The PARTICIPANT must appear online punctually at the agreed time.

2.3. Technical Interruptions: If the ONLINE SERVICE cannot be conducted as planned due to technical problems on the TRAINER’s side, the CUSTOMER will be informed, and a replacement date will be arranged. Interruptions on the CUSTOMER’s side do not entitle them to a refund or replacement, unless the TRAINER is notified of potential issues at least 24 hours in advance.

3. Payment Terms and Refunds

3.1. Payment Terms: The fee for the ONLINE SERVICE must be paid in full upon booking unless otherwise agreed in writing. Payment is made via an online payment service.

The CUSTOMER is not entitled to a refund in cases of no-show or technical problems on their side.

3.3. Transfer of Participation Rights: Transfer of participation rights to another person is not permitted unless explicitly and formally approved by Fischer Consulting OHG.

4. Data Protection and Confidentiality

4.1. Data Protection: The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR). The TRAINER commits to maintaining confidentiality regarding all information and personal data received during the ONLINE SERVICE.

4.2. Recordings and Confidentiality: The CUSTOMER and PARTICIPANT agree not to make audio or video recordings of the ONLINE SERVICE without the explicit consent of the TRAINER. All shared information, content, and materials are to be treated confidentially.

5. Intellectual Property and Use of Materials

5.1. Intellectual Property: All materials, documents, videos, or recordings provided during the ONLINE SERVICE are the intellectual property of the TRAINER and may only be used by the PARTICIPANT for personal use.

5.2. Usage and Distribution: The materials may not be copied, shared with third parties, or published. The PARTICIPANT is not granted any rights to store or distribute the content unless explicitly approved in writing by the TRAINER.

6. Liability Disclaimer

6.1. No Guarantee of Results: The ONLINE SERVICE constitutes a “best-effort obligation,” meaning the TRAINER does not guarantee specific results. The success of the measures depends on the active cooperation of the PARTICIPANT, and no liability is assumed for unmet objectives.

6.2. Limitation of Liability: The TRAINER is only liable for damages caused intentionally or through gross negligence. Liability for indirect damages, consequential damages, or loss of profits is excluded.

7. Jurisdiction and Applicable Law

7.1. Applicable Law: These GTC and the ONLINE SERVICE are governed by Italian law.

7.2. Jurisdiction: The competent courts in Bruneck (BZ) or Bolzano (BZ) will have jurisdiction over disputes relating to these GTC or the ONLINE SERVICE unless mandatory legal provisions stipulate otherwise.
